Terms and Conditions

Welcome to Abdools Catering Equipment.

These Terms and Conditions (“Terms”) govern your use of our website and the purchase of any industrial or commercial catering equipment from Abdools Catering Equipment Company, We are based in Kathu, Northern Cape. By accessing our website or placing an order, you agree to be bound by these Terms.

Please read them carefully before completing any transaction.

1. Company Information

  • Main Operations Base: Kathu, Northern Cape, South Africa

  • Years of Operation: Continuous since 1998

  • Core Business: Supply of industrial and commercial culinary, bakery, refrigeration, and butchery equipment.

2. Commercial & Industrial Use Application

All equipment sold by Abdools Catering Equipment is manufactured, designed, and intended exclusively for commercial, industrial, or professional food service environments. The warranties, installation requirements, and return policies reflect business-to-business (B2B) standards and commercial usage rather than domestic household rules.

3. Quotations, Pricing, and Orders

  • Validity of Quotes: Given the nature of heavy-duty industrial equipment, all written quotations issued by us are valid for a strict period of 14 days from the date of issue, unless stated otherwise.

  • Pricing Fluctuations: We reserve the right to adjust pricing without prior notice due to fluctuations in exchange rates, manufacturing costs, or shipping fees prior to order confirmation.

  • Order Acceptance: An order is only deemed accepted and binding once we issue a formal invoice and receive the required deposit or full payment into our designated bank account.

4. Payment Terms

  • Unless a formal commercial credit agreement has been authorized by our management in writing, all orders require a 100% payment upfront or a strictly agreed-upon deposit structure before goods are dispatched or specialized equipment is ordered from manufacturers.

  • Goods remain the sole property of Abdools Catering Equipment until full payment has cleared in our bank account.

5. Delivery, Collection, and Risk

  • Delivery Scope: Based in Kathu, we facilitate delivery across the Northern Cape and surrounding regions. Delivery charges are calculated based on weight, dimensions, and distance, and will be specified on your invoice.

  • Risk Transfer: Risk of damage or loss transfers to the client immediately upon delivery to the specified address or upon collection of the items by the client (or their chosen courier) from our Kathu facility.

  • Lead Times: Any delivery timeframes quoted are estimates only. While we leverage our 28+ years of logistics experience to ensure promptness, we are not liable for manufacturer delays or shipping supply chain disruptions.

6. Installation and Specialized Utilities

  • Client Responsibility: It is the client’s sole responsibility to ensure that the delivery site has the correct electrical phases (e.g., 3-phase power for heavy industrial ovens), plumbing connections, ventilation, and gas certifications required for the specific equipment.

  • Certified Technicians: Many commercial equipment items (specifically gas and refrigeration units) must be installed by an accredited, certified professional technician. Failure to provide proof of certified installation will completely void the manufacturer's warranty.

7. Warranties and Returns

  • Manufacturer Warranties: All new industrial machinery carries the standard warranty provided by the respective manufacturer. Abdools Catering Equipment will assist clients in processing legitimate warranty claims with the manufacturer.

  • Exclusions: Warranties strictly exclude wear-and-tear components (such as lightbulbs, gaskets, glass elements, or blades) and damage caused by power surges, lack of water filtration (scale build-up), or operator negligence.

  • Returns Policy: Because commercial catering items are heavy capital equipment, returns on correctly supplied items are generally not accepted. Any approved return of a stocked item may be subject to a handling and restocking fee of up to 15%, and the item must be completely unused, in its original crating/packaging.

8. Limitation of Liability

To the maximum extent permitted by South African law, Abdools Catering Equipment shall not be held liable for any indirect, incidental, or consequential losses, including but not limited to loss of business profits, spoiled stock, or kitchen downtime resulting from equipment delays or technical malfunction.

9. Governing Law

These Terms and any agreements regarding the sale of equipment shall be governed by and interpreted in accordance with the laws of the Republic of South Africa, and any legal proceedings will fall under the jurisdiction of the relevant local courts in the Northern Cape.

Updates to These Terms

We reserve the right to update or modify these terms at any time to reflect changing economic regulations or logistical practices. The terms live on our website at the time of your invoice will be the terms applicable to your purchase.
